Non-profits have been taking HUGE advantage of us since the law exempts them. They seem to think the more they annoy us, the better off they are..??... I don't understand their way of thinking. All I know is, if I had ever thought of giving them any money at one time, that thought flew away the first few days they started calling...I think the law needs to be changed. It should be after you have asked them 2 or 3 times (no more than that...) to take your name off their list, and to please stop calling, that if they continue to call, then they would be in violation of the law just like the telemarketers, and would be fined and what ever else just the same as the common criminals (telemarketers)..... They have been calling me for weeks and weeks SEVERAL times a DAY. I finally had enough of it and called the number a few nights ago. I actually got to leave a message, I couldn't believe it. Any way, I left a message asking them to please take my number off their list, and to PLEASE stop calling me. And if they continued, I would be forced to complain about them to the FTC. I repeated my phone number again, said thank you and hung up...Its after midnight now, and just realised that I haven't received  any calls from them today, NONE at all... WOW!!  I'm hoping that it wasn't just a fluke, and they missed me for just the one day..lol..  I am not holding my breath waiting to see if I make it another day without their calls though..lol..I'm hoping, no, I'm praying, that my being polite but stern, may have done the trick the very first time..lol..  TIME will tell..lol.. Good luck to ALL of us on one day having a silent phone..lol..

I got a call from them for a past medical bill. Its a legit bill but I was unaware of it because its something my insurance was supposed to cover. When I called them back after they left a message they gave me the date of the visit and the clinic it was at so that I could verify it. I called the clinic and it was legit. Then I called my insurance and they fixed it.

I just got a call from them today while I'm at work. All she did was leave a voicemail saying that I need to get a hold of her gave me her name number and reference number... Ummm but excuse I'm not going to call you back if I don't know what company is calling me and in regards to what... So she shouldn't be expecting a phone call from me. I just dished out almost 2 grand for medical bills that I owed from my hospital stay last year. My boyfriend has never had debt collectors call him for his medical debt and yet now I'm getting harrassed because I owe money when the state wouldn't even help me? They were going to start garnishing my wages before I paid it off completely. This is crazy!

Had a call from this collector who "claims" I owe on a medical "past debt going back to 2005...Asked for copies of the original bill so I can validate but haven't recieved anything to help me varify. This is becoming annoying.  They also use different numbers each time so it becomes an issue of they say and I say and the annoyance continues.  I want concerns in writing clearly with original statements...I have no idea who or what is collecting for ...?

Just got a call from this number. ID'd as "Cell Phone  OR"Robo-call started "This is not a sales call. There has been a rise in crime in your neighborhood..." Don't know the rest because I hung up. I then called the number, and was answered - amazing in itself. "Jay speaking". Me: I just got a call from this number about a 'rise in crime'. Please take my number off your list!" Jay (the same voice as on the recording): "We'll send the burglars over!" Hunh!  I'm not sure who hung up quicker. Outrageous!

When I see unidentified/unwanted calls on my ID unit, I just pick the phone up and immediately hang back down. The gov't isn't much interested in stopping this, it's selective enforcement of the law. I just had a similar experience. They are calling a business however via computer, there have been several calls this week, but after having started during our company greeting, I kept missing the opportunity to get a person on the line. Finally I did today. I told them the person no longer worked for our company ( hasn't for over 4 years). The person on the other end was extremely rude, and insisted that the ex-employee gave this number. After a few other unpleasant exchanges she hung up on me while I was answering her question. FACT: It is unnecessary to call an individual an infinite amount of times to badger about a debt.FACT: Any entitled creditor has the right to communicate with the debtor about the debt, in writing, but not continuously over the phone just to badger in an attempt to harass, embarrass, or humiliate an individual into submission.FACT: Federal Law requires that any creditor cease telephoning upon request from the individual being called.FACT: There is nothing that cannot be communicated by phone that cannot be communicated by letter.  Not getting the desired response does not entitle a creditor (or assigned collection agency) to repeatedly badger a debtor by telephone.  Clearly, badgering or harassing a debtor with repeated calls demonstrates that the intent is not to communicate (as the debtor already knows about their debt and that the creditor wants their money), but to intimidate or coerce by being a constant nuisance. A collection agency calls you (the non-debtor) as you were listed as a reference by the debtor..The idea is to harass you so you will lean on your friend, or family member, as you get frustrated at getting called.  This is suppose to embarrass the debtor into paying out of public humiliation and shame.Again, an illegal BS tactic

Here’s how to do that:Make a copy of your letter. Send the original by certified mail, and pay for a “return receipt” so you’ll be able to document what the collector received. Once the collector receives your letter, they may not contact you again, with two exceptions: a collector can contact you to tell you there will be no further contact or to let you know that they or the creditor intend to take a specific action, like filing a lawsuit. Sending such a letter to a debt collector you owe money to does not get rid of the debt, but it should stop the contact. The creditor or the debt collector still can sue you to collect the debt. Can a debt collector contact anyone else about my debt?If an attorney is representing you about the debt, the debt collector must contact the attorney, rather than you. If you don’t have an attorney, a collector may contact other people – but only to find out your address, your home phone number, and where you work. Collectors usually are prohibited from contacting third parties more than once. Other than to obtain this location information about you, a debt collector generally is not permitted to discuss your debt with anyone other than you, your spouse, or your attorney.What does the debt collector have to tell me about the debt? Every collector must send you a written “validation notice” telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don’t think you owe the money. Can a debt collector keep contacting me if I don’t think I owe any money? If you send the debt collector a letter stating that you don’t owe any or all of the money, or asking for verification of the debt, that collector must stop contacting you. You have to send that letter within 30 days after you receive the validation notice. But a collector can begin contacting you again if it sends you written verification of the debt, like a copy of a bill for the amount you owe.What practices are off limits for debt collectors?Harassment. Debt collectors may not harass, oppress, or abuse you or any third parties they contact. For example, they may not:     use threats of violence or harm;     publish a list of names of people who refuse to pay their debts (but they can give this information to the credit reporting companies);     use obscene or profane language; or     repeatedly use the phone to annoy someone. False statements. Debt collectors may not lie when they are trying to collect a debt. For example, they may not:     falsely claim that they are attorneys or government representatives;     falsely claim that you have committed a crime;     falsely represent that they operate or work for a credit reporting company;     misrepresent the amount you owe;     indicate that papers they send you are legal forms if they aren’t; or     indicate that papers they send to you aren’t legal forms if they are. Debt collectors also are prohibited from saying that:     you will be arrested if you don’t pay your debt;     they’ll seize, garnish, attach, or sell your property or wages unless they are permitted by law to take the action and intend to do so; or     legal action will be taken against you, if doing so would be illegal or if they don’t intend to take the action. Debt collectors may not:     give false credit information about you to anyone, including a credit reporting company;     send you anything that looks like an official document from a court or government agency if it isn’t; or     use a false company name. Unfair practices. Debt collectors may not engage in unfair practices when they try to collect a debt. For example, they may not:     try to collect any interest, fee, or other charge on top of the amount you owe unless the contract that created your debt – or your state law – allows the charge;     deposit a post-dated check early;     take or threaten to take your property unless it can be done legally; or     contact you by postcard. Can I control which debts my payments apply to? Yes. If a debt collector is trying to collect more than one debt from you, the collector must apply any payment you make to the debt you select. Equally important, a debt collector may not apply a payment to a debt you don’t think you owe.Can a debt collector garnish my bank account or my wages?If you don’t pay a debt, a creditor or its debt collector generally can sue you to collect. If they win, the court will enter a judgment against you. The judgment states the amount of money you owe, and allows the creditor or collector to get a garnishment order against you, directing a third party, like your bank, to turn over funds from your account to pay the debt. Wage garnishment happens when your employer withholds part of your compensation to pay your debts. Your wages usually can be garnished only as the result of a court order. Do I have any recourse if I think a debt collector has violated the law? You have the right to sue a collector in a state or federal court within one year from the date the law was violated. If you win, the judge can require the collector to pay you for any damages you can prove you suffered because of the illegal collection practices, like lost wages and medical bills. The judge can require the debt collector to pay you up to $1,000, even if you can’t prove that you suffered actual damages. You also can be reimbursed for your attorney’s fees and court costs. A group of people also may sue a debt collector as part of a class action lawsuit and recover money for damages up to $500,000, or one percent of the collector’s net worth, whichever amount is lower. Even if a debt collector violates the FDCPA in trying to collect a debt, the debt does not go away if you owe it.What should I do if a debt collector sues me?If a debt collector files a lawsuit against you to collect a debt, respond to the lawsuit, either personally or through your lawyer, by the date specified in the court papers to preserve your rights. I download the fair credit collection PDF and from my last 3 calls which I have recorded I have compiled a list of ways your s****y company collects which I am turning over to the BBB in a formal report. Good luck keeping your license. When a credit collector tells me that if I dont post a payment at that time he will be waiting for me when I get home, pretty sure rules are getting broken. It is there job to get the person that they are looking for.  What happens if the said deadbeat changes their phone number or has their cell phone taken away, that number is giving to someone else.  Most of the collection agencies are automated now,  it is very unfortunate and rude to be calling a house during dinner time, 7 o'clock in the morning on a Saturday or Sunday, or 11 o'clock at night.  It is not my responsibility to do their job just so they leave me alone.  Nor is it right to give away any personal information, family or not so that they can collect their money.  If they have a problem with a person, let them do the research themselves, if they cannot get the information they need, let them sue the person.  A lot of these banks and debt collection agencies are screwing people with their interest charges and s***, at a time of recession, I think the government should try and help the poor, instead of making it impossible to have your 3 basic needs, let alone money to see a doctor if you are sick, or lose a limb or two.

I don't answer any calls I don't know and I delete messages before listening to them. My mom gets calls, she is 91, and she has had her phone # for about 40 yrs, it would have been longer but the phone company changed her # about 1969 AND SHE GETS CALLS. EXPLAIN THAT

these guys as with any collection company buy bad debt for fractions of pennies on a dollar.  They are paid on commission so the more they call and search the more money they make.  Understandable right?  However, when they call the wrong person and think you are lying that is where the line is crossed.More so than not they have the right people and they know it, however when they really are calling the wrong people "I am not this person" should be enough.  When you are rude back, that is a sign you indeed are the right person.  When you are very matter of factish and just simply say 'you have the wrong number" and be nice.  Chances are they will bark up another tree.So take those tips as free advise...hahaha

When someone phones your home or cell phone, you are under no obligation to give them any information at all about yourself or other people.  Further more, they are basically on a fishing expedition - calling people with the same or similar name as a person who owes money.  This means a good number of the people they call are not dead beats and should never be called in the first place.  When CPC phones someone and that person advices them not to call any longer, that should be the end of it!  That's the law.  I truly suspect you, ParisMom, work for CPC!  You think the people from CPC want to stop being jerked around?  What about the peopel they are illegally harrassing?  I'm a bit sick of their calls!  I don't owe anyone any money, they have the wrong person! They do not care!Also, I'd be a bit careful giving out information about other people!  For all you know, that's not the person this company is truly looking for!

Hi Folks and happy holidays. Here's a bit of information around this topic. 1) Each state has a statute of limitations on when debt is deemed not having to be paid. However, the law does not state that the collector has to stop calling you - they can still try to collect, even though the statute of limitations has passed. IMPORTANT: If you are close to your statute of limitations, DO NOT pay them anything (even if they settle for 2% of the total debt). Also, do not get into any payment agreement with these types of companies. The 2 aforementioned activities WILL re-set the statute of limitations on the debt (as far as your credit report. EXAMPLE: a) You have 2 years left on the statute of limitations. b) You get into an agreement with them (even verbal if they are recording, which they may do if they tell you ahead of time) or you make a small payment toward the debt. Outcome is that reporting on your credit report will re-start from the day of the above.

Vegas: You're 100% on the money with that.Collection agencies badger anyone who will entertain them.  I know of an older couple who paid one off just to get rid of them.  $1500 dollars.IT WASN'T EVEN THEIR DEBT!When they moved here from Arizona the new phone # they were assigned was that of someone who'd skipped out on a credit card debt.  I talked them into persueing it legally to try to get their money back but when all was said & done they would've lost well more than the $1,500 dollars they got screwed out of on legal fees trying to recover it.
