Same here...called but didn't recognize number so no answer (if it isn't even in my same area code, not getting answered basically is the rule I follow) cell phone but no message left.  Considering all of the posts have originated this month (February 2012) it looks like it's probably a new scam.Just a heads up folks that next month I believe is when telemarketers can LEGALLY begin to solicit cell phone numbers (I know like they haven't been doing it anyways).  There is a 1-888 number that we can now call to have our cell phones on the Do-Not-Call list BUT you HAVE TO call from the cell phone that you want to be on the list.  I had the number written down here somewhere but can't find it at the moment however I am sure if you google it or something you will come across it.  TOGETHER WE CAN DEFEAT THESE SCAMMERS!!

This number called me, stated that they could lower my credit card rates (not sure what rates they mean)  So I stayed on the line to have myself permanently removed from the calling list.  When I asked to removed, the agent hung up on me.  Whomever owns this DNIS needs to be prosecuted for non compliance with DNC.

It drives me crazy with todays technoloy there is NOT a way to STOP soliciting calls. I to received calls form all these #s when you try to call the #s back every one of them say (the # is not in service). First thing you have to do is file a complaint with "The Do Not Call List", second file a complaint with the www.FFC.GOV, they are working on stopping these calls What You Can Do...The FCC can issue warning citations and impose fines against companies violating or suspected of violating the do-not-call rules, but does not award individual damages. If you receive a telephone solicitation that you think violates any of these rules, you can file a complaint with the FCC. There is no charge for filing a complaint. You can file your complaint using an online complaint form. You can also file your complaint with the FCC’s Consumer Center by calling 1-888-CALL-FCC (1-888-225-5322) voice or 1-888-TELL-FCC (1-888-835-5322) TTY; faxing 1-866-418-0232; or writing to:Federal Communications Commission Consumer & Governmental Affairs Bureau Consumer Inquiries & Complaints Division 445 12th Street, SW Washington, DC 20554.What to Include in Your ComplaintThe best way to provide all the information the FCC needs to process your complaint is to complete fully the online complaint form. When you open the online complaint form, you will be asked a series of questions that will take you to the particular section of the form you need to complete. If you do not use the online complaint form, your complaint, at a minimum, should indicate:your name, address, email address and phone number where you can be reached;the phone number where you received the call, and whether this number is on the national Do-Not-Call list;the date and time of the call;whether the call advertised or sold any property, goods, or services;any information (including a caller ID number) to help identify the individual or company whose property, goods, or services were being advertised or sold, and whether any of this information was provided during the call;whether you or anyone else in your household gave the caller permission to call;whether you have an EBR with the caller (specifically, whether you or anyone else in your household made any purchases of property, goods, or services from the individual or company that called, or made any inquiry or filed an application with the individual or company prior to receiving the call); andwhether you or anyone in your household previously asked the caller or individual or company whose property, goods, or services are being advertised or sold NOT to call, and when you made the request. Some states permit you to file law suits in state court against persons or entities violating the do-not-call rules. You may be awarded $500 in damages or actual monetary loss, whichever is greater. The amount may be tripled if you are able to show that the caller violated the rules willfully and knowingly. Filing a complaint with the FCC does not prevent you from also bringing a suit in state court.States also can bring a civil law suit against any person or entity that engages in a pattern or practice of violating the TCPA or FCC rules. You can contact your state Attorney General’s office or consumer protection agency with particular complaints, or to encourage such suits.Print Out

Caveat! According to White Pages, there really is a charity called Life Giving Moments, that functions something like A Child's Wish and the like. It seems to have set up one of its shops in the "four corners" section out west. However, since I have been deluged with calls from these people, this is what I have noticed: The Caller ID has changed from LGIVINGMOMENTS to LIFEGIVMOMENTS. One afternoon last week, I saw the LGM ID come up on my phone, so I pounded on the # key some couple of dozen times.A hysterical woman's voice came on, demanding to know what I thought I was doing. In the last second, I heard a man's voice start to speak. Then the call ended.I do not care what charity they represent. They can content themselves by putting notices in church bulletins to get their word out.

Got a call from this number. Caller ID said "LIFEGIVMOMENTS". Roommate picks up the phone. The woman asked for Wendy. Roommate replied "Which one?" because there are two of us in this house who have the same name. Caller sighed and was rude but then started to ask her nosy and fake "survey" questions. Roommate hands phone to me. Caller asks if I agree or disagree about whether today's TV shows give a bad message to children. I told her I didn't understand why she was asking me that, and she just goes "Okay, BYE!" and hangs up.Screw these people with their phony "surveys" asking all kinds of stuff that's none of their business.

Thinkin this is just another scammer. We've been getting a ton of them lately and it's hard to keep track of them all. Never leave a message and I don't care to call them back. Most calls come to the home phone, but I've had a couple on my cell as well. Made the mistake of answering one as I was expecting a call and the call was placed from my local area code. When the guy started to ask me for personal info, I faked a bad connection and hung up. They haven't called back. This stuff is getting rediculous!!!!!

The Federal Trade Commission (FTC), the nation’s consumer protection agency, enforces the Fair Debt Collection Practices Act (FDCPA), which prohibits debt collectors from using abusive, unfair, or deceptive practices to collect from you.Under the FDCPA, a debt collector is someone who regularly collects debts owed to others. This includes collection agencies, lawyers who collect debts on a regular basis, and companies that buy delinquent debts and then try to collect them. Here are some questions and answers about your rights under the Act.What types of debts are covered? The Act covers personal, family, and household debts, including money you owe on a personal credit card account, an auto loan, a medical bill, and your mortgage. The FDCPA doesn’t cover debts you incurred to run a business. Can a debt collector contact me any time or any place? No. A debt collector may not contact you at inconvenient times or places, such as before 8 in the morning or after 9 at night, unless you agree to it. And collectors may not contact you at work if they’re told (orally or in writing) that you’re not allowed to get calls there. How can I stop a debt collector from contacting me?If a collector contacts you about a debt, you may want to talk to them at least once to see if you can resolve the matter – even if you don’t think you owe the debt, can’t repay it immediately, or think that the collector is contacting you by mistake. If you decide after contacting the debt collector that you don’t want the collector to contact you again, tell the collector – in writing – to stop contacting you. Here’s how to do that:Make a copy of your letter. Send the original by certified mail, and pay for a “return receipt” so you’ll be able to document what the collector received. Once the collector receives your letter, they may not contact you again, with two exceptions: a collector can contact you to tell you there will be no further contact or to let you know that they or the creditor intend to take a specific action, like filing a lawsuit. Sending such a letter to a debt collector you owe money to does not get rid of the debt, but it should stop the contact. The creditor or the debt collector still can sue you to collect the debt. Can a debt collector contact anyone else about my debt?If an attorney is representing you about the debt, the debt collector must contact the attorney, rather than you. If you don’t have an attorney, a collector may contact other people – but only to find out your address, your home phone number, and where you work. Collectors usually are prohibited from contacting third parties more than once. Other than to obtain this location information about you, a debt collector generally is not permitted to discuss your debt with anyone other than you, your spouse, or your attorney. What does the debt collector have to tell me about the debt? Every collector must send you a written “validation notice” telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don’t think you owe the money. Can a debt collector keep contacting me if I don’t think I owe any money? If you send the debt collector a letter stating that you don’t owe any or all of the money, or asking for verification of the debt, that collector must stop contacting you. You have to send that letter within 30 days after you receive the validation notice. But a collector can begin contacting you again if it sends you written verification of the debt, like a copy of a bill for the amount you owe. What practices are off limits for debt collectors?Harassment. Debt collectors may not harass, oppress, or abuse you or any third parties they contact. For example, they may not:     use threats of violence or harm;     publish a list of names of people who refuse to pay their debts (but they can give this information to the credit reporting companies);     use obscene or profane language; or     repeatedly use the phone to annoy someone. False statements. Debt collectors may not lie when they are trying to collect a debt. For example, they may not:     falsely claim that they are attorneys or government representatives;     falsely claim that you have committed a crime;     falsely represent that they operate or work for a credit reporting company;     misrepresent the amount you owe;     indicate that papers they send you are legal forms if they aren’t; or     indicate that papers they send to you aren’t legal forms if they are. Debt collectors also are prohibited from saying that:     you will be arrested if you don’t pay your debt;     they’ll seize, garnish, attach, or sell your property or wages unless they are permitted by law to take the action and intend to do so; or     legal action will be taken against you, if doing so would be illegal or if they don’t intend to take the action. Debt collectors may not:     give false credit information about you to anyone, including a credit reporting company;     send you anything that looks like an official document from a court or government agency if it isn’t; or     use a false company name. Unfair practices. Debt collectors may not engage in unfair practices when they try to collect a debt. For example, they may not:     try to collect any interest, fee, or other charge on top of the amount you owe unless the contract that created your debt – or your state law – allows the charge;     deposit a post-dated check early;     take or threaten to take your property unless it can be done legally; or     contact you by postcard. Can I control which debts my payments apply to? Yes. If a debt collector is trying to collect more than one debt from you, the collector must apply any payment you make to the debt you select. Equally important, a debt collector may not apply a payment to a debt you don’t think you owe.Can a debt collector garnish my bank account or my wages? If you don’t pay a debt, a creditor or its debt collector generally can sue you to collect. If they win, the court will enter a judgment against you. The judgment states the amount of money you owe, and allows the creditor or collector to get a garnishment order against you, directing a third party, like your bank, to turn over funds from your account to pay the debt. Wage garnishment happens when your employer withholds part of your compensation to pay your debts. Your wages usually can be garnished only as the result of a court order. Don’t ignore a lawsuit summons. If you do, you lose the opportunity to fight a wage garnishment. Can federal benefits be garnished? Many federal benefits are exempt from garnishment, including:     Social Security Benefits     Supplemental Security Income (SSI) Benefits     Veterans’ Benefits     Civil Service and Federal Retirement and Disability Benefits     Service Members’ Pay     Military Annuities and Survivors’ Benefits     Student Assistance     Railroad Retirement Benefits     Merchant Seamen Wages     Longshoremen’s and Harbor Workers’ Death and Disability Benefits     Foreign Service Retirement and Disability Benefits     Compensation for Injury, Death, or Detention of Employees of U.S. Contractors Outside the U.S.     Federal Emergency Management Agency Federal Disaster Assistance But federal benefits may be garnished under certain circumstances, including to pay delinquent taxes, alimony, child support, or student loans. Do I have any recourse if I think a debt collector has violated the law? You have the right to sue a collector in a state or federal court within one year from the date the law was violated. If you win, the judge can require the collector to pay you for any damages you can prove you suffered because of the illegal collection practices, like lost wages and medical bills. The judge can require the debt collector to pay you up to $1,000, even if you can’t prove that you suffered actual damages. You also can be reimbursed for your attorney’s fees and court costs. A group of people also may sue a debt collector as part of a class action lawsuit and recover money for damages up to $500,000, or one percent of the collector’s net worth, whichever amount is lower. Even if a debt collector violates the FDCPA in trying to collect a debt, the debt does not go away if you owe it.What should I do if a debt collector sues me?If a debt collector files a lawsuit against you to collect a debt, respond to the lawsuit, either personally or through your lawyer, by the date specified in the court papers to preserve your rights. Where do I report a debt collector for an alleged violation?Report any problems you have with a debt collector to your state Attorney General’s office (www.naag.org) and the Federal Trade Commission (www.ftc.gov). Many states have their own debt collection laws that are different from the federal Fair Debt Collection Practices Act. Your Attorney General’s office can help you determine your rights under your state’s law.For More InformationTo learn more about debt collection and other credit-related issues, visit www.ftc.gov/credit and MyMoney.gov, the U.S. government’s portal to financial education. The FTC works for the consumer to prevent fraudulent, deceptive, and unfair business practices in the marketplace and to provide information to help consumers spot, stop, and avoid them. CAREY, Vice President (spouse?)--------------------------------------------------------------------------------Bud Says                         Consumer Comments Below This is a nasty group of highly unprofessional and illegal debt collectors who think they can break the law to collect on debts. We got involved with them over a debt that (by their own records) is time barred from taking legal actions, yet they chose to lie, misrepresent themselves, contact a consumer job after repeatedly being told not to. They do not have any license or bonds that we could find. Both James Fredrick Vehslage and Candace J. Carey are listed as living at the same address in Glendale AZ. The first impression we have of these illegal debt collectors is they have motor mouthed debt collectors who talk faster than cockroach running for cover and think their collection antics are above the law. It appears from our vantage point that they purchased a very old portfolio of old; appear to be worthless debts that they are trying to intimidate consumers into paying. It’s the unprofessional attitude and illegal debt collection tactics they are using that made us wonder if they have a drug testing policy for their employees and perhaps the owners. They are incorporated in South Dakota for those of you lining up to file lawsuits, dont yet know how deep their pockets are, or how many lawsuits they will be able to pay off at this time, however it appears there will be many. James Vehslage is listed as the AZ agent for service at the 2333 Northern Ave, #4, Glendale, AZ address. A check of court cases confirms what I have suspected that they have been sued numerous times this year for abusive debt collection activity, which should come as no surprise.  This group of illegal debt collectors is on a fast track to the courthouse where they may be paying off a LOT of lawsuits for being stupid so let’s help them along. They are collecting debts illegally, so do NOT send them any money. They are liars and con men, do NOT send them any money. They are sleazy bottom feeder junk debt collectors who typically never have any legal documents to prove up their claims, do NOT send them any money. We suspect one or more criminals may be working there, do NOT send them any money. This is a slimy, disgusting organization, stay far away from them. NEVER give a Peak Financial debt collector any information on your bank or credit cards, they may take money they are NOT legally entitled to. Contact us for assistance and referral to a local consumer law professional and do NOT have any dealings with Peak Financial. CAUTION: I recommend you NEVER disclose your bank account or credit card information to a debt collector, as you risk them emptying your account, or maxing out your credit card. If you feel they are reporting on your credit bureau files in error or need assistance in dealing with them, email  the details w/your location.  Assistance and referral to a consumer legal specialist may be available.File complaints with Federal Trade Commission  https://www.ftccomplaintassistant.gov/FTC_Wizard.aspx?Lang=enYour State Attorney General State Attorney General is every state they have offices Link to all State Attorney General Websites www.naag.orgIf you or they are located in NY – use this SPECIAL Link  www.NYDebtHelp.comThis special website was created by NY AG Andrew Cuomo specifically for reporting illegal debt collection practices.  HE’S CRACKING DOWN AND SHUTTING THEM DOWN!Also report your calls and contacts with debt collectors at http://www.budhibbs.com/index.html  If the company is listed under agencies – report there. SOUNDS LIKE BS FROM A DEBT COLLECTOR no one has ever benefited from paying a collection agency If you are not a debt collector - let us know when the NEW collection agencies start to call you.   Because this one stole your money and sold your debt to another agency - who will do the same thing!

These people are A-holes.  We sent a letter to cancel our service and they are saying they needed it by Friday, the 15th and received it on Monday, the 18th.  They are actually trying to hold us to another year contract because the mail didn't get to them in time, even though our letter is dated the 12th. And the cancellation is actually for the following month on the 15th.  I have been on hold for over 55 minutes and every time they transfer me to the person I am trying to follow up with I mysteriosly get disconnected.  If you are considering using this company - DON'T!  I feel their practices are unethical and to try to trap people into a contract they don't want is ridiculous.  I have never had this many problems trying to cancel a contract before.  I guess this is why their Better Business Bureau rating is C- with over 1430 complaints, wish I would of known this before I signed up!  Today I will be filing a complaint with the Better Business Bureau and the Attorney General.  If others are having these issues, I would advise to also file complaints.  THERE IS STRENGTH IN NUMBERS!

Send them written notice return receipt so you have proof. Check your state and local laws. Some states have laws against auto renewal for anything other than on a month to month. Judging by all the complaints against this company your not gonna be able to believe a word they say over the phone. Do some research yourself sit down type out letters and do your homework. Register a complaint with your states Attorney General if they get enough of them you never know they might help you out. It sounds like this company opperates on the edge of the law just to get a little more money out of customers. Good luck.

Yeah but when  you want to change alarm systems and paid your 5 years is it fair that you can't because they don't want to let you out of the contract. that is our hard earned pay that we use to pay theM and when the 5 year contract is up and we want to go to another company that is our right to do so. why shoud we be a prisoner to anyone or anything. TO BE LOCKED INTO AN ADDITONAL 1-2 YEAR CONTRACT.

I use the system every time I leave the house. I have screwed up twice and didn't get to the pad in time to stop it. Ten seconds after I got a call. I had forgotten my password once and it took a minute to find it. Which was to long and the police were on the way. Three minutes and they were there. I have had no complaints. If I call them they give me the info I need and I'm on my way. Over two years now and I'm happy with them.If you barely use the system why did you have them install it? Are you planning on blaming Vivant when your house is broken into and you failed to set your alarm? Typical BS from people that specialize in BS!

I thought I was the only one having to deal with this from them,  I am so angry with Vivint right now I can't even see straight,  my contract with them expires at the end of this month,  however I was not aware that I was required to send a letter in writing to them telling them that I wanted to cancel my service, but unfortunately for me,  I did not send it in 30 days prior to the cut off date, and now they automatically renewed my account for another year,  I really hope they get the crap sued out of them and have to close up shop,  what a greed underhanded evil deceitful company.  I even asked what would happen if I decided not to pay them anymore,  they say after 120 days they would send it to the credit reporting agencies and it would go against my credit report.   I understand if you signed a contract,  being locked into a deal,  but I never signed an 1 year extension,  how is this even legal?  they weren't even the same company when I signed up.
