The Federal Trade Commission (FTC), the nation’s consumer protection agency, enforces the Fair Debt Collection Practices Act (FDCPA), which prohibits debt collectors from using abusive, unfair, or deceptive practices to collect from you.Under the FDCPA, a debt collector is someone who regularly collects debts owed to others. This includes collection agencies, lawyers who collect debts on a regular basis, and companies that buy delinquent debts and then try to collect them. Here are some questions and answers about your rights under the Act.What types of debts are covered? The Act covers personal, family, and household debts, including money you owe on a personal credit card account, an auto loan, a medical bill, and your mortgage. The FDCPA doesn’t cover debts you incurred to run a business. Can a debt collector contact me any time or any place? No. A debt collector may not contact you at inconvenient times or places, such as before 8 in the morning or after 9 at night, unless you agree to it. And collectors may not contact you at work if they’re told (orally or in writing) that you’re not allowed to get calls there. How can I stop a debt collector from contacting me?If a collector contacts you about a debt, you may want to talk to them at least once to see if you can resolve the matter – even if you don’t think you owe the debt, can’t repay it immediately, or think that the collector is contacting you by mistake. If you decide after contacting the debt collector that you don’t want the collector to contact you again, tell the collector – in writing – to stop contacting you. Here’s how to do that:Make a copy of your letter. Send the original by certified mail, and pay for a “return receipt” so you’ll be able to document what the collector received. Once the collector receives your letter, they may not contact you again, with two exceptions: a collector can contact you to tell you there will be no further contact or to let you know that they or the creditor intend to take a specific action, like filing a lawsuit. Sending such a letter to a debt collector you owe money to does not get rid of the debt, but it should stop the contact. The creditor or the debt collector still can sue you to collect the debt. Can a debt collector contact anyone else about my debt?If an attorney is representing you about the debt, the debt collector must contact the attorney, rather than you. If you don’t have an attorney, a collector may contact other people – but only to find out your address, your home phone number, and where you work. Collectors usually are prohibited from contacting third parties more than once. Other than to obtain this location information about you, a debt collector generally is not permitted to discuss your debt with anyone other than you, your spouse, or your attorney. What does the debt collector have to tell me about the debt? Every collector must send you a written “validation notice” telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don’t think you owe the money. Can a debt collector keep contacting me if I don’t think I owe any money? If you send the debt collector a letter stating that you don’t owe any or all of the money, or asking for verification of the debt, that collector must stop contacting you. You have to send that letter within 30 days after you receive the validation notice. But a collector can begin contacting you again if it sends you written verification of the debt, like a copy of a bill for the amount you owe. What practices are off limits for debt collectors?Harassment. Debt collectors may not harass, oppress, or abuse you or any third parties they contact. For example, they may not:     use threats of violence or harm;     publish a list of names of people who refuse to pay their debts (but they can give this information to the credit reporting companies);     use obscene or profane language; or     repeatedly use the phone to annoy someone. False statements. Debt collectors may not lie when they are trying to collect a debt. For example, they may not:     falsely claim that they are attorneys or government representatives;     falsely claim that you have committed a crime;     falsely represent that they operate or work for a credit reporting company;     misrepresent the amount you owe;     indicate that papers they send you are legal forms if they aren’t; or     indicate that papers they send to you aren’t legal forms if they are. Debt collectors also are prohibited from saying that:     you will be arrested if you don’t pay your debt;     they’ll seize, garnish, attach, or sell your property or wages unless they are permitted by law to take the action and intend to do so; or     legal action will be taken against you, if doing so would be illegal or if they don’t intend to take the action. Debt collectors may not:     give false credit information about you to anyone, including a credit reporting company;     send you anything that looks like an official document from a court or government agency if it isn’t; or     use a false company name. Unfair practices. Debt collectors may not engage in unfair practices when they try to collect a debt. For example, they may not:     try to collect any interest, fee, or other charge on top of the amount you owe unless the contract that created your debt – or your state law – allows the charge;     deposit a post-dated check early;     take or threaten to take your property unless it can be done legally; or     contact you by postcard. Can I control which debts my payments apply to? Yes. If a debt collector is trying to collect more than one debt from you, the collector must apply any payment you make to the debt you select. Equally important, a debt collector may not apply a payment to a debt you don’t think you owe.Can a debt collector garnish my bank account or my wages? If you don’t pay a debt, a creditor or its debt collector generally can sue you to collect. If they win, the court will enter a judgment against you. The judgment states the amount of money you owe, and allows the creditor or collector to get a garnishment order against you, directing a third party, like your bank, to turn over funds from your account to pay the debt. Wage garnishment happens when your employer withholds part of your compensation to pay your debts. Your wages usually can be garnished only as the result of a court order. Don’t ignore a lawsuit summons. If you do, you lose the opportunity to fight a wage garnishment. Can federal benefits be garnished? Many federal benefits are exempt from garnishment, including:     Social Security Benefits     Supplemental Security Income (SSI) Benefits     Veterans’ Benefits     Civil Service and Federal Retirement and Disability Benefits     Service Members’ Pay     Military Annuities and Survivors’ Benefits     Student Assistance     Railroad Retirement Benefits     Merchant Seamen Wages     Longshoremen’s and Harbor Workers’ Death and Disability Benefits     Foreign Service Retirement and Disability Benefits     Compensation for Injury, Death, or Detention of Employees of U.S. Contractors Outside the U.S.     Federal Emergency Management Agency Federal Disaster Assistance But federal benefits may be garnished under certain circumstances, including to pay delinquent taxes, alimony, child support, or student loans. Do I have any recourse if I think a debt collector has violated the law? You have the right to sue a collector in a state or federal court within one year from the date the law was violated. If you win, the judge can require the collector to pay you for any damages you can prove you suffered because of the illegal collection practices, like lost wages and medical bills. The judge can require the debt collector to pay you up to $1,000, even if you can’t prove that you suffered actual damages. You also can be reimbursed for your attorney’s fees and court costs. A group of people also may sue a debt collector as part of a class action lawsuit and recover money for damages up to $500,000, or one percent of the collector’s net worth, whichever amount is lower. Even if a debt collector violates the FDCPA in trying to collect a debt, the debt does not go away if you owe it.What should I do if a debt collector sues me?If a debt collector files a lawsuit against you to collect a debt, respond to the lawsuit, either personally or through your lawyer, by the date specified in the court papers to preserve your rights. Where do I report a debt collector for an alleged violation?Report any problems you have with a debt collector to your state Attorney General’s office (www.naag.org) and the Federal Trade Commission (www.ftc.gov). Many states have their own debt collection laws that are different from the federal Fair Debt Collection Practices Act. Your Attorney General’s office can help you determine your rights under your state’s law.For More InformationTo learn more about debt collection and other credit-related issues, visit www.ftc.gov/credit and MyMoney.gov, the U.S. government’s portal to financial education. The FTC works for the consumer to prevent fraudulent, deceptive, and unfair business practices in the marketplace and to provide information to help consumers spot, stop, and avoid them. Check your state's laws governing collectors. In some states, you can mail a letter via Certified Mail, advising them that they are not to call you at work, home, etc. If you prohibit them from calling, you can ask them to only enter their requests in writing. If you don't owe the debt they are attempting to collect, you can report them to your state's office of the Attorney General.

Good thing we have the internet to research numbers....Because there's so much of this these days, best thing to do, is to not pick up if you see a number you do not recognize. Don't even call back. If it's really that important,  the caller can leave a message. Imagine the worst: your voice recorded, your location spotted, charges for international calls, number used for fraud in credit, etc....etc. The list can go on. Don't think too much or get paranoid, just don't pick up (period).

Got this call this  morning, it is a spam call message in Spanish about a cash prize that you have "won" and they will ask you for personal info in order to clean out your bank or credit card accounts. It says something like "the cash register just open for you, you have won a big amount of money" or something like that

Received call just now was in Spanish said that I had won $1000.00 to press one to claim prize. What a waist of time. Would rather have junk mail in the mail not on my phone. I suppose the phone company wants me to pay to prevent receiving these calls. Any by the way english please.

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:is seeking payment on a debt for a loan you do not recognize; refuses to give you a mailing address or phone number; asks you for personal financial or sensitive information; or exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency. If you think that a caller may be a fake debt collector:Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act. If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you. Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing. Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft – charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name. Contact your creditor. If the debt is legitimate – but you think the collector may not be – contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt. Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.> http://www.ftc.gov/bcp/edu/pubs/consumer/alerts/alt076.shtm

I have reported Mr. Jackson and Lezama Lester and Assoc. to the FBI, FTC, and the Attorney General's Office.  I suggest each of you do the same.  This company also operated under another name in Atlanta and was shut down by the FTC, and reopened under this other name in North Carolina.  I was told by the AG's office that Mr. Jackson committed several criminal offenses, including extortion, impersonating a law enforcement officer, impersonating an officer of the court (atty), harrassment, stalking, and terroristic threats.  The problem is....we don't get the real name of these people.  They may all be one in the same, using aliases.  I have an atty and this is being aggressively handled both in civil and criminal court.  I have enough to get a warrant sworn for Mr. Jackson, so we are working now on his real identity.  We'll see who eats his words....once he is the one arrested at his job as he threatened would happen to me.  We have him recorded calling me a criminal and many other disturbing verbal tirades as he enjoys hearing himself talk, yet allows no one else to speak.  This guy is slick.  Send a cease and desist to 336 217-7992, which is the real fax number, not what is shown on the website, which is false.  Also send one certified mail to the address listed on their site.  You will not get anywhere trying to get this man to send you anything in the mail to validate your debt, and even if the debt is valid, the practices he is using are not legal.  Good Luck.

I got a call from Mr. Jackson last Monday threatening me regarding federal article 805-11 under the federal fraud statute for a pay day loan, and advising the FDIC was involved.  He "danced around" threatening me with being picked up at my office (arrested?) right before Christmas, and he just couldn't stand to see that happen.  I adv him I work in a law office, as he should know because he called me here, and I said let me put a lawyer on the phone right now and he backed off a bit, stating uh, well if you want them to send me a letter stating they are representing you, otherwise I can't talk to them.  So I said okay, and just let them come arrest me then.  He says, well okay, I can't get a "stop action" on this "order" without a payment plan. The lawyers here checked everything out and it was all a total lie.  He even lied and said the bank I had used and had the account closed on was involved in this action against me.  Also a fib.  I did owe the money and arrange a payment plan I could live with, but don't fall for the lies.  Make a payment plan you can keep and don't get bullied by Mr. Jackson, because...he's really good at what he does.

I received my first call from Mr. Jackson today but it was from 404-781-3610.  Previously he had gotten in contact through a message to a family member stating they were listed in a complaint to commit Federal Fraud due to an unpaid balance on a payday loan.  I was taken in as quickly as my family member was.  I had spoken to him several times and waited on phone calls back from him which never came until today.  he tells me my number is phony and he is unable to reach me, however, he reached me through his cell phone that is from the Atlanta Georgia area.  When I got curious about the Federal code 805-11, I searched it and came across a posting on Who is this Number, with many complaints about Mr. Jackson with regard to payday loans.  I then called the payday loan company I had used and was informed their procedure on unpaid balances was to forward them to a collection agency, not seek federal fraud charges.I had given the "nice" Mr. Jackson my credit card information and had to make a trip to the bank to make sure no transfers could be made with that card and then waited for him to call.  I had also talked with a FBI agent at our local facility in regards to Mr. Jackson's calls.  I was informed to file a complaint with the Federal government on internet crimes at www.IC3.gov.     If you have received these calls, do not give your information, make sure you report it.  It is very important so that we may stop SCAMS such as this one.

I just received an internet famous call from Mr. Jackson!!You would think he would NOT be dumb enough to call again, after speaking with my Local Sheriffs Department, but nope, here he is calling again! Threatening again...Only this time he did his homework & actually knew the name of my County Court System~ LOL (thats a good thing to know when trying to scare money out of someone!)Little does he know, my husband is an ex loan consolidation rep, who actually DID HELP people pay off loans...Haha, jokes on Mr Jackson.PLEASE DO NOT GIVE THIS MAN YOUR INFO!!!!Stand your ground, ask for HIS INFO, & PROOF OF DEBT IN WRITING!!! You MUST state that~ "I want proof of MY debt, in writing, mailed to me. Only then will I respond to your request for payment, either admitting or denying my part of this debt." That way when you are "being recorded" you neither admit, nor deny any obligation. If the debt is real, you will get verification, if you dont, No loss!As far as verification, DO NOT accept an email!!! Mail only, & make SURE it is LEGAL documents that were signed with the original company that you obtained loan or service with, NOT COLLECTION CO LETTERHEAD~ that is NOT verification!!If they refuse to send you verification, block the number, report it to FCC, & go file a report with the local Police Dept. This is VERY IMPORTANT to do, if you believe the debt is NOT YOURS, or you already paid it. Give them any info you have on Mr Jackson, including that fake name, the number he called from, the firm he claims to work for, & specific notes written using specific words that he used to threaten you.For fun, you can inform Mr Jackson that your Local PD has his info & will be contacting him shortly! He likes that ;0)Hope this helps!

Weve already paid off the payday loan, and we havent committed check fraud, so we told him we have the paperwork to prove it, he said some really rude things, and we told him to stop calling, about 3 times now, its always either him or some lady that answers and says we owe these debts that we dont owe, and this morning they called again and my husband told them to stop calling and now we're getting this call about a case complaint from Mr. Jackson, whoever the hell that is! When dialing the number back absolutely nothing happens, it does not ring and the call goes nowhere. So who is calling us and why, why do they call us and ask us to speak with a mortgage rep and then no one comes on the phone when I press the appropriate option EVEN if I DID want to refinance!!!How does one file a complaint against a company that calls you but no one is there?

I have pressed 9 twice now to have myself removed from this list and they still call me!  so infuriating

Why should I have to call this Mortgage lender back, to have my number removed from their call list.  Which doesn't work either.  They wait a few weeks and start calling, again.

They called my cell phone while I was away from my desk and didn't leave a message.  I added it to my address book as Unknown Caller XX (where x is the number not previously assigned).  Then for that caller I can set the alarm volume to silent.  So when they call again I'll never heard them.  Not sure if their call goes against my minutes however?

I am on the do not call list for my number and should not be receiving these types of calls

We are on the Do Not Call list, yet these idiots have called us 3 or 4 times this month and this is just the start of the 3rd week.  If they wanted anyone to listen to their BS they shouldn't start the call with "President Obama".  He's not everyone's favorite guy right now.

If you have a store discount card, not only are your purchases reported to these "Marketing Companies" but your telephone # is sold to them. So to get even with them, give these harrassment telephone numbers to stores when applying for the store card. Never never give your real name to them. use a keyword name for all, so that you can identify the callers source of your number and information. This does NOT apply to credit or debit cards.

Got a missed call from 916-437-0643 on 3/4/11 at 6:22pm and decided to look it up since I know no one from that area code.   Found many notes and links related to this number saying that it's a scam, but have no idea how they couldve gotten my cell number, I'm not even from northern Ca.

Folks, be aware many of the short want-more-info posts may be scammer shills designed to drive negative comments off this first page. "Furious MOM" reports on page 3 that her son is being charged $9 every time you respond to the text. $265/month for a rent-to-buy home is a fake offer. A k$100 home might go for k$150 and take 47 years to pay off at $265/month - this is way too long and too risky for any lender. This is a fake offer.
