lamet-most of your information is correct. However, a person's request for validation is not limited to within the first 30 days after the debt collector first sends their dunning letter stating you have 30 days to respond. If you read the applicable law, it only states that 30 days after the initial letter, the debt collector may consider it valid. Just because the debt collector considers it valid does not make it so. You can request validation at any time that you first become aware of the debt. Unless the debt collector has a signed return receipt confirmation showing you received such contact, no time frame is valid. You might run your credit reports and find debts listed you know nothing about. You can request validation at that point. Or you might not be aware of said debt until you are actually served with a summons and complaint to appear in court. You can request validation during those proceedings. And if you handle your requests in a certain manner, you could even turn the table on the debt collector and sue them for fraudulent credit reporting and/or debt collection practices. An excellent website which has a wealth of information on debt collection and credit reporting in plain english, as well as explaining exactly how to proceed with debt validation is located here:http://www.creditinfocenter.com/rebuild/debt_validation.shtml

The Federal Trade Commission (FTC), the nation’s consumer protection agency, enforces the Fair Debt Collection Practices Act (FDCPA), which prohibits debt collectors from using abusive, unfair, or deceptive practices to collect from you.Under the FDCPA, a debt collector is someone who regularly collects debts owed to others. This includes collection agencies, lawyers who collect debts on a regular basis, and companies that buy delinquent debts and then try to collect them. Here are some questions and answers about your rights under the Act.What types of debts are covered? The Act covers personal, family, and household debts, including money you owe on a personal credit card account, an auto loan, a medical bill, and your mortgage. The FDCPA doesn’t cover debts you incurred to run a business. Can a debt collector contact me any time or any place? No. A debt collector may not contact you at inconvenient times or places, such as before 8 in the morning or after 9 at night, unless you agree to it. And collectors may not contact you at work if they’re told (orally or in writing) that you’re not allowed to get calls there. How can I stop a debt collector from contacting me?If a collector contacts you about a debt, you may want to talk to them at least once to see if you can resolve the matter – even if you don’t think you owe the debt, can’t repay it immediately, or think that the collector is contacting you by mistake. If you decide after contacting the debt collector that you don’t want the collector to contact you again, tell the collector – in writing – to stop contacting you. Here’s how to do that:Make a copy of your letter. Send the original by certified mail, and pay for a “return receipt” so you’ll be able to document what the collector received. Once the collector receives your letter, they may not contact you again, with two exceptions: a collector can contact you to tell you there will be no further contact or to let you know that they or the creditor intend to take a specific action, like filing a lawsuit. Sending such a letter to a debt collector you owe money to does not get rid of the debt, but it should stop the contact. The creditor or the debt collector still can sue you to collect the debt. Can a debt collector contact anyone else about my debt?If an attorney is representing you about the debt, the debt collector must contact the attorney, rather than you. If you don’t have an attorney, a collector may contact other people – but only to find out your address, your home phone number, and where you work. Collectors usually are prohibited from contacting third parties more than once. Other than to obtain this location information about you, a debt collector generally is not permitted to discuss your debt with anyone other than you, your spouse, or your attorney. What does the debt collector have to tell me about the debt? Every collector must send you a written “validation notice” telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don’t think you owe the money. Can a debt collector keep contacting me if I don’t think I owe any money? If you send the debt collector a letter stating that you don’t owe any or all of the money, or asking for verification of the debt, that collector must stop contacting you. You have to send that letter within 30 days after you receive the validation notice. But a collector can begin contacting you again if it sends you written verification of the debt, like a copy of a bill for the amount you owe. What practices are off limits for debt collectors?Harassment. Debt collectors may not harass, oppress, or abuse you or any third parties they contact. For example, they may not:     use threats of violence or harm;     publish a list of names of people who refuse to pay their debts (but they can give this information to the credit reporting companies);     use obscene or profane language; or     repeatedly use the phone to annoy someone. False statements. Debt collectors may not lie when they are trying to collect a debt. For example, they may not:     falsely claim that they are attorneys or government representatives;     falsely claim that you have committed a crime;     falsely represent that they operate or work for a credit reporting company;     misrepresent the amount you owe;     indicate that papers they send you are legal forms if they aren’t; or     indicate that papers they send to you aren’t legal forms if they are. Debt collectors also are prohibited from saying that:     you will be arrested if you don’t pay your debt;     they’ll seize, garnish, attach, or sell your property or wages unless they are permitted by law to take the action and intend to do so; or     legal action will be taken against you, if doing so would be illegal or if they don’t intend to take the action. Debt collectors may not:     give false credit information about you to anyone, including a credit reporting company;     send you anything that looks like an official document from a court or government agency if it isn’t; or     use a false company name. Unfair practices. Debt collectors may not engage in unfair practices when they try to collect a debt. For example, they may not:     try to collect any interest, fee, or other charge on top of the amount you owe unless the contract that created your debt – or your state law – allows the charge;     deposit a post-dated check early;     take or threaten to take your property unless it can be done legally; or     contact you by postcard. Can I control which debts my payments apply to? Yes. If a debt collector is trying to collect more than one debt from you, the collector must apply any payment you make to the debt you select. Equally important, a debt collector may not apply a payment to a debt you don’t think you owe.Can a debt collector garnish my bank account or my wages? If you don’t pay a debt, a creditor or its debt collector generally can sue you to collect. If they win, the court will enter a judgment against you. The judgment states the amount of money you owe, and allows the creditor or collector to get a garnishment order against you, directing a third party, like your bank, to turn over funds from your account to pay the debt. Wage garnishment happens when your employer withholds part of your compensation to pay your debts. Your wages usually can be garnished only as the result of a court order. Don’t ignore a lawsuit summons. If you do, you lose the opportunity to fight a wage garnishment. Can federal benefits be garnished? Many federal benefits are exempt from garnishment, including:     Social Security Benefits     Supplemental Security Income (SSI) Benefits     Veterans’ Benefits     Civil Service and Federal Retirement and Disability Benefits     Service Members’ Pay     Military Annuities and Survivors’ Benefits     Student Assistance     Railroad Retirement Benefits     Merchant Seamen Wages     Longshoremen’s and Harbor Workers’ Death and Disability Benefits     Foreign Service Retirement and Disability Benefits     Compensation for Injury, Death, or Detention of Employees of U.S. Contractors Outside the U.S.     Federal Emergency Management Agency Federal Disaster Assistance But federal benefits may be garnished under certain circumstances, including to pay delinquent taxes, alimony, child support, or student loans. Do I have any recourse if I think a debt collector has violated the law? You have the right to sue a collector in a state or federal court within one year from the date the law was violated. If you win, the judge can require the collector to pay you for any damages you can prove you suffered because of the illegal collection practices, like lost wages and medical bills. The judge can require the debt collector to pay you up to $1,000, even if you can’t prove that you suffered actual damages. You also can be reimbursed for your attorney’s fees and court costs. A group of people also may sue a debt collector as part of a class action lawsuit and recover money for damages up to $500,000, or one percent of the collector’s net worth, whichever amount is lower. Even if a debt collector violates the FDCPA in trying to collect a debt, the debt does not go away if you owe it.What should I do if a debt collector sues me?If a debt collector files a lawsuit against you to collect a debt, respond to the lawsuit, either personally or through your lawyer, by the date specified in the court papers to preserve your rights. Where do I report a debt collector for an alleged violation?Report any problems you have with a debt collector to your state Attorney General’s office (www.naag.org) and the Federal Trade Commission (www.ftc.gov). Many states have their own debt collection laws that are different from the federal Fair Debt Collection Practices Act. Your Attorney General’s office can help you determine your rights under your state’s law.For More InformationTo learn more about debt collection and other credit-related issues, visit www.ftc.gov/credit and MyMoney.gov, the U.S. government’s portal to financial education. The FTC works for the consumer to prevent fraudulent, deceptive, and unfair business practices in the marketplace and to provide information to help consumers spot, stop, and avoid them. Got a call from a woman asking for a male name.  I'm a female living alone. The bizarre thing is that my maiden name is the same as the (very common) last name of the person she was looking for.  When I told her she had the wrong number, she didn't believe me. Actually said that it was "obvious" because of my last name being the same as his (even though I'm listed by my former married name, which is NOT the same as the person she was looking for).  How she got that information is highly suspicious, especially since I live alone and my listed name would NOT be the one she is looking for.  When I reiterated that I was not that person, she yelled "LADY, PUT HIM ON THE PHONE!".  I told her that's impossible since I don't know him, and I've had this number for years.  She called me a B*tch and while I was hanging up, I heard her say "I'm dialing you back Lady".  I heard beeps, hung up, and she called right back, although I didn't answer.

Anyone who receives harrassing phone calls from either telemarketers or collection agencies should report them to the Federal Trade Commission.  Trust me once you file a report with the FTA, you'll never hear from these idiots again.  The FTC does not condone this kind harrassment to the community, they always get their job done.

DIdn't get to phone in time.  Called back the number.  A young man answered saying the Northland Group.  I told them I just received a call and they new what number I was calling from and was looking for a person that must of had my number before me.  He was very polite though, and appoligized. I have had this number for at least 2 years.

That is correct this is some collection number. They are very rude and would not provide me any information about why they are calling.
Report by Nancy Long ago Unknown
Received a few calls from this #. They left a message asking to call back but would not tell the reason for the call, or whom this message is for. Did some googling and found the name of the company behind the number in question. It's Northland Group - a collection agency. We just got a new number, they must be colling looking for someone else.

Yesterday received 3rd call from "Americans for Prosperity Foundation." The first two were on Sept. 29 from 703-224-3200, but the one yesterday was identified on my caller id as: "Survey Call 253-246-8536".  The two September callers left recorded messages stating that the caller was from AFPF (one time gave name as Joel Aaron), who left messages relating to my property rights, meetings, etc. I called the 703 number, and a pleasant young lady explained they were "grassroots organization... news about events in your area... fiscal responsibility.... non-partisan." She also referred to the "Defending the American Dream Summit November 4 and 5 in Washington DC" and said there was a web site, www.DefendingTheAmericanDream.org, which I didn't bother to check out. I asked her to remove me from their call list, and she said she would. Yesterday's recorded message was from a "Nick Walker with Americans for Prosperity Foundation," saying something about my property rights and the Maryland Plan(?) and advising me of a "Town Hall" on Thurs. night 11/3 at ____ Senior Center. Also invited me to call 866-730-0150. I just called that toll free # which was answered by a gentleman identifying himself as Francis. He did not know why I would be receiving calls about issues and meetings related to the Maryland area. Francis did say that he was in the headquarters office of AFPF, and was located in the Washington DC area. I advised him that I had previously asked my number to be put on their do not call list. He checked and said my number was on the list and that he did not know why I was still receiving calls, but that he would follow up.

FEDERAL TRADE COMMISSION WEBSITE      http://www.ftc.gov/bcp/edu/pubs/consumer/alerts/alt134.shtm‘Free Government Grants’: Don’t Take Them For Grant-ed“Because you pay your income taxes on time, you have been awarded a free $12,500 government grant! To get your grant, simply give us your checking account information, and we will direct-deposit the grant into your bank account!” Sometimes, it’s an ad that claims you will qualify to receive a “free grant” to pay for education costs, home repairs, home business expenses, or unpaid bills. Other times, it’s a phone call supposedly from a “government” agency or some other organization with an official sounding name. In either case, the claim is the same: your application for a grant is guaranteed to be accepted, and you’ll never have to pay the money back. Don’t give out your bank account information to anyone you don’t know. Scammers pressure people to divulge their bank account information so that they can steal the money in the account. Always keep your bank account information confidential. Don’t share it unless you are familiar with the company and know why the information is necessary. Don’t pay any money for a “free” government grant. If you have to pay money to claim a “free” government grant, it isn’t really free. A real government agency won’t ask you to pay a processing fee for a grant that you have already been awarded — or to pay for a list of grant-making institutions. The names of agencies and foundations that award grants are available for free at any public library or on the Internet. The only official access point for all federal grant-making agencies is www.grants.gov. Look-alikes aren’t the real thing. Just because the caller says he’s from the “Federal Grants Administration” doesn’t mean that he is. There is no such government agency. Take a moment to check the blue pages in your telephone directory to bear out your hunch — or not. Phone numbers can deceive. Some con artists use Internet technology to disguise their area code in caller ID systems. Although it may look like they’re calling from Washington, DC, they could be calling from anywhere in the world.

This is a cel phone used by a scam artist to get your bank account info with the promise of a $7000 government grant becuase you have paid your taxes on time. They want you to authorize a $110 fee payment from your bank account for the grant application and then they will deposit $7000 in your bank account within 1 hour. My bank told me there is no way they can directly deposit into a bank account within 1 hour - it takes at least overnight to get funds transferred. The original phone call comes from a blocked number giving you a approval code that you then have to relay to the person at this number - all have4 very thick Indian accents. DO NOT GIVE THEM YOUR BANK INFORMATION......

Thanks Brenda.  I just filled out the form.  As one post already pointed out, they do ask for an email.   I created a temporary email that I can dispose of in case I get spam on that.   I keep my cell phone number very protected and very rarely give it out.  I would LOVE to know how they got my number.  While on their site, I noticed there is a fax number... one for the Michigan address where their calls come from.  I wonder if they use digital fax or an old fashioned fax with paper and ink.  Either way, constant faxes are annoying... but paper and ink all black faxes get the recipient's attention!.  I am going to create an all black sheet of paper (in case they have a paper and ink fax system) with a little box in the middle with a message: Do Not Contact and put in my phone number.) This works great for unwanted faxes as well.  I will send it from my office where I can set my digital pbx  phone system to block any incoming numbers I want.  Here's the fax number if anyone else wants to try it: Livonia, MIMarket Strategies InternationalCorporate Headquarters 17430 College ParkwayLivonia, MI 48152Phone: 734.542.7600Fax: 734.542.7620

Brenda, you are a fool, or you work for them. The 'Do Not Call' List is controlled by law, and says that if you are not a customer, nor have been a customer for the preceding 12-months, of the company calling, or you have not contractually given authorization for that company to explicitly call you, then they MUST abide by the 'no cold calls' rule. They cannot initiate calls without response.People, you do NOT have to give them anything, other than to state that they are NOT to call the number that you give them. If they refuse to list you, then ensure that their company is listed with your state Do Not Call, or Federal Do Not Call listing admin. If they persist, contact your local district attorney regarding violation of the Do Not Call Law, and ask for them to pursue the matter.Don't give parasites the benefit of a doubt - pursue them to the full extent that the law allows.

It's not as simple as you make it seem: they won't remove your number from their calling list unless you give them your personal info, and I simply do not trust them with that.  They demand your name and email address in addition to the phone number you want removed.I'm sorry, but I don't think they should get my personal info just to get my phone number off their list.  When they call again, I'm just going to tell them to remove my number from their database and see how that works.

Lots of good info -- especially the link and simple instructions for how to get the survey company to stop calling my cell phone, 3-4 times in one day!  I wasn't answering, but wondered who it was.  The discussions were food for thought -- right to privacy vs. freedom of speech... but I still don't want to be disturbed on my cell phone and it uses up minutes that I have to pay for!  Thanks again!

These crooks are professional privacy invaders, if there was any doubt the website removal should completely eliminate it. You want to know what kind of subhumans you're dealing with? Just look at the posts on this page from "Patricia Kelly" who is apparently a professional privacy invader who hones her sociopathic skills on the phone and on this site too.Blow a loud whistle in the phone when you get one of these subhumans on the phone. If they don't get it the first time, REPEAT. Nothing says STOP CALLING FOREVER like the whistle -- nothing. Although I hear an airhorn works pretty well too.

They called for a "survey" related to an inquiry that "I had placed with my power company".  I was polite and said that I have never placed an inquiry.  The woman was pushing telling me that I must have had a concern on recent bill. Said, no.  She then told me that I would be required to hold that she would return with a reason for the call.  Please, being placed on hold by a "survey".  Told her for privacy reasons any inquiries that I ever placed are not discussed with random people calling me that are clearly not associated with an organization that I do business with.  As I have never called or emailed my utility company since the initial order; this company is trying to obtain personal information - very concerning.  Beware -

Yes, the Do Not Call list DOES apply to this Company. If it were a Charity it would be okay, and even then when you call and your Company is a Charity you still have to take them off the list. You know who gives our phone number out the most? The Telephone Company!!! They all make money giving out our numbers. It doesn`t matter if it is unlisted or not, they still give it out. I have Caller ID, I just don`t answer it.Plus the computerized ones go numerically, so it doesn`t matter, unless the person on the other end harrasses you, then you can report them.

The problem with callers such as this is they don't quit.   I have record from my Caller ID of 6 different attempts to reach me within 24 hours.  2 of those where while I was at home, but on the other phone line with a family member and I didn't break the call waiting to answer an unfamiliar number.   I like most people have a VM system on my phone and anyone calling can leave me a message at anytime with a contact number that I may return their call if I feel it is important, and if I do not, I would not return it, which should also be treated as a lack of interest in said Survey, Merchandise, Opinion or what not.

Patricia,  Thank you for the "other side of the fence" view.  We think of this all the time when We get these unwanted calls but since we "inherited" this phone number over 5 yrs ago, we got buried with the previous owner's debt collection calls and this owner had a lot of creditors and still continues to use our phone number.  It would be risky changing the number because it may be worse than the 5-10 calls per month for this low life and his wife. If we do answer the phone, we explain to the caller that these people have not had this number for over 5yrs and to remove our number immediately from their calling list, and call the local police department.  It's great when we go for days without calls from marketing, scammers and political calls.  We love our privacy but so far this month, we've logged over 30 calls and that's 30 that we did not answer.  We should have the option as to be on call list or not and that's why we voice on this site.  It shows that we are not alone. As far as your SS case, have you considered going Congressional? Or, obtaining a SS advocate?  Contact AARP.

Bottom line is you don't have a right to call anybody that doesn't want to be called,  If I tell you the first time you call that I don't want to be called again then as far as I'm concerned I'd now better be on your no call list.  Continuing to call people who have told you not to call whether the DNC list applies or not is considered harrassment and can be prosecuted whether you are a survey company, non profit or anything else not covered by the DNC.  YOU DO NOT HAVE CARTE BLANCH TO KEEP CALLING AFTER THAT PERIOD.You sound like a stupid entitled whiney liberal who thinks the world owes you something.

My goodness Kelley, you are certainly bitter.  The fact remains, people do not want to be called.  The key term is "called."  If people want to give their opinions or have their voices heard, they will choose to do so.  That means, they will CALL YOU...not the other way 'round.  I sometimes answer surveys on the internet or that I've received in the mail because they do not represent and inconvenience nor a bother.  I am not "forced" to get up from a meal and answer the phone.  I am not "forced" to answer a million questions as read by someone whose identity I cannot verify...etc.  I can choose to ignore a letter or an email but a ringing telephone does not afford that choice.  You are essentially saying "here we are" you must deal with us in some way...NO I will not.  I have blocked all calls except those that I want to receive.  I have a call blocker that holds 2,700 phone numbers...more than enough.  Now...as for all your "disabilities."  If you see yourself as disabled..you are...There are thousands of jobs available for online and for those who can do nothing but use a telephone.  Contact your local job service and request a meeting.  You'll find something else I'm sure..as for having to pay your disability and welfare...well perhaps that's better than having you annoy us.

If you go to the official FTC website DoNOTCALL.gov Market Research companies, political polls, charities and any company you have done business with in the past 18 months are 100% exempt from the No Call List. If you click on the tab on this site that says exemptions to the list it tells you in black and white. We do not have to buy the list from the government and download it like the telemarketers do. Of course when you try to educate them about they will say every time "I do not care" many times. That is why the world is so messed up because people are selfish and have this "I do not care" attitude.  I have on and off worked in call centers for 15 years. We are not trying to sell ANYTHING nor rip any one off and never have. The call center I work at has been in business for 35 years and if they had ripped anyone off or tried to sell anything we would not still be in business now. People need jobs. As of two days the unemployment rate is highter than it has been in 34 years. People just want to believe because they are selfish and uneducated that thsi applies to ALL CALLS. The news media made it to where everyone believes it applies to all calls. I've even talked to people that say they even tell their dentist, unemployemnt office and stores not to call them even to verify an appointment or if something they want has came in.If they are going to be like that and jerks then they do not deserve to be helped in any relm of customer service. The bottom line is this-you can be mean, cruel, yelling, mean and nasty or whatever but it is not going to change anything at all. The federal government depends on Market Research companies for all their studies and work and that is the purpose for the exemptions. I am disabled and have been since 1999 and have a  year college degree and cannot get any other type of work due to cognitive, coordinational as well and mental and physical disabilities. I have been fighting with SS for 9 years and have to work until I am able to win my case. I have no other choice, otherwise I will die. It is not as if I can crawl under a bridge somewhere. People like me which I work with quite a few of them that are challenged, need these jobs to be able to survive. I did not sign this petition to the law and saw it and it clearly said the law applied to "sales calls only"/telemarketers. People in Market Research are not telemarketers nor do they "solicit" anything. If we do not work we do not pay taxes which you will have to pay and not me- nor will we be paying into unemployment which would cause the amount available to you when you are out of a job to go down as well. Think about this when you are yelling and screaming and being rude to us.

Most of these companies are so unprofessional and not too far removed from the lot of thieves.  DW got itright. The "remove from list" option is used by many to simply get more verified information,....or at leastto confirm your phone number. Most of their "business" is scamming like "free" gift certificates, so do youthink they'll respect a "DO NOT CALL!" list? The best action is to never answer and if they happen to get you on the phone, hang up without saying or buying anything.

I finally took their call since it was obvious they weren't going to stop calling our office until I did.  They had my name, and wanted me to complete their survey about shipping.  I asked who contracted them to do the survey and she refused to identify them, saying it was for "all of the shipping companies".  Pfft.  Also, some of the questions were out of line, like asking how much our company spent on shipping last year.  I refused to answer those questions. At the end of the survey, she made an offer to participate in a more detailed survey online in exchange for a $35 gift certificate, good at over 300 online retailers.  I declined.Something fishy about this, but we'll see.  If I start getting slammed with telemarketing from freight companies, I will know who to seek recourse from.  The caller was adamant they would not sell my name and number to other companies.

Got these calls and answered the phone.  A man with a heavy accent said they were doing something for Medicare.  I am not on Medicare and told him I didn't want to answer his questions.  These people are so annoying.  They keep calling and calling.  If he calls back, I am going to complain.  This company does have a web site with some impressive information but, hey, anybody can say anything on a web site.  Frankly, I do not think this was a legitimate call.

Thank you for the information.  I just got off the list too.  I only have one comment for these callers.  I PAY for my phone service and should be able to control the use of my service.  I am not willing to pay for these callers, the interruptiions or for my time talking with you.  Find some other way and quit bothering the rest of us.

We have gotten a phone call from 714-333-9972 about our resort vacation property, that we don't own, of course. Then we received three phone calls within minutes from 610-757-0021 and a wireless number, 610-241-6120. We don't know what they wanted because I recorded a very sarcastic message and left it to answer our calls. I ask for all of their personal information, credit cards, bank cards, pin numbers, account numbers, their name, their mother's maiden name etc. so that we can rip them off. Not one of these people have left the information I asked them to leave after telling them up front that we were going to rip them off. Imagine that!!! Perhaps more people should have a message set up on their phones just for the telemarketer/scammers and warn your family about it in advance. Maybe they will get the message that they are wasting their time. It's sweet revenge!

Usual scammers. If the answering machine gets it, the robocall begins playing. Best as I can tell, I have won (oh goody!) an all-expenses paid something from "my resort." Sure I have. Unusual here is that they leave a callback number - 619-800-7516. I don't call scammers back; if anyone else wants to try and learn more, be my guest.

I got a message at work taped to my computer, saying to call Kenneth Brooks from the State Crime Division and that it was urgent. When I tried calling the number, the call would not go through.

A guy named Kenneth called from this number today. Saying I have three serious charges against me and started reading a false affadavit with charges. An affadavit is a sworn statement. Not charges. Saying I took out a payday loan for $500. Which I didn't. Saying I should take care of it out of court and they were going to pick me up. I have proof that didn't happen. So they want your money and are making excuses to get money. I believe this is a total scam.

An Indian man called repeatedly then started calling from private, blocked and 911 numbers. He sued filthy language, claimed to be from the secret service, a bounty hunter. a total idiot.  left repeated voice mails.  Total scam.
